Subpoena Service

Subpoena Service Anywhere in Michigan

We serve witness and records subpoenas anywhere in the state, which MCR 2.506(G)(1) allows in the manner provided by MCR 2.105.

A subpoena is the one serve where money changes hands at the door. The attendance and mileage fee has to be tendered at the time of service, in cash, by money order, by cashier’s check, or by a check drawn on the account of an attorney of record. Our server carries the fee you provide, hands it over with the subpoena, and returns a signed proof of exactly what happened.

Subpoenas we deliver

  • Witness subpoenas for trials, hearings and depositions
  • Subpoenas that ask for documents or records
  • Subpoenas to a party, or to an officer, director or managing agent of a party
  • Subpoenas that need personal service after a mailed acknowledgment card never came back

What a subpoena serve needs before we head out

  1. Send the signed subpoena and the appearance date

Unless the court orders otherwise, MCR 2.506(C)(1) requires service at least 2 days before the appearance, or 14 days before it when documents are requested. The appearance date tells us how much room is left.

  2. Include the fee in a form the rule accepts

Cash, a money order, a cashier’s check, or a check from the attorney of record’s account. A personal check or a payment app transfer is not on the list, and a serve without an accepted fee has to be made again.

  3. Tell us whether the person is a party

A subpoena to a party, or to a party’s officer, director or managing agent, may be served under MCR 2.107 and needs no fee. Knowing that changes how the serve is planned.

  4. We deliver and record

Every attempt is logged with its date, time and place, and the finished serve comes back as a signed proof stating how the subpoena and fee were handed over.

Subpoena service questions

Can a subpoena be mailed instead of served in person?

MCR 2.506(G)(2) allows mailing with a postage-paid acknowledgment card. If the card does not come back, the rule requires personal service, and the 2-day or 14-day window has been shrinking the whole time. Many clients send the subpoena for personal service from the start for that reason.

How much is the witness fee?

The amounts are set by statute, MCL 600.2552, and they change over time. Confirm the current figure with the court or the attorney on the case, then send it with the subpoena so our server can tender it at the door.

Do you prepare or issue subpoenas?

No. The subpoena is issued and signed before it reaches us. We serve it, tender the fee you supply, and document the serve. Who to subpoena, and how to respond to one, are questions for the attorney handling the case.
