Eviction Papers Served for Michigan Landlords and Property Managers

A Michigan eviction is served in two rounds, and we handle the delivery in both: the written demand or notice before the case is filed, then the district court summons and complaint after it is.

We deliver papers and document the delivery. We do not file evictions, appear at hearings, or carry out a writ of possession; a court officer or sheriff executes the writ.

Landlord and tenant papers we serve

  • Demands for possession for nonpayment of rent
  • Notices to quit that end a tenancy
  • District court summonses and complaints once the case is filed
  • Other landlord and tenant notices the landlord or attorney has prepared

The two rounds of an eviction serve

  1. Round one: the notice

The landlord or attorney chooses and completes the notice. For nonpayment of rent, MCL 600.5714(1)(a) sets 7 days from service of a written demand for possession, so the period counts from the day the tenant receives it.

  2. We deliver it and log the visit

Because the notice period runs from service, the date and manner of delivery matter. Each attempt is recorded, and audio-video, GPS coordinates or a time-stamped photo can be added on request.

  3. Round two: the summons and complaint

After the notice period ends and the case is filed in district court, the court issues a summons. We serve the summons and complaint on the tenant.

  4. Proof for the landlord’s file

The completed serve returns as a notarized affidavit of service, ready for the landlord or attorney to file.

Questions landlords ask about serving eviction papers

Which notice does my eviction need?

That depends on the reason for the eviction and the lease, and it is a question for your attorney or the court’s forms. Once the notice is prepared, we deliver it and document the delivery.

Do you file the eviction case?

No. Filing the case, appearing at the hearing, and enforcing a judgment are handled by the landlord, the attorney and the court. Our work is delivering the papers and proving the delivery.

Can the delivery be recorded?

Yes, on request. Under Michigan’s one-party consent rule our server can record the serve on audio and video, and GPS coordinates and a time-stamped photo can be attached to an attempt.
